The Commission also criticized the use by the FA of performance evidence, which, according to him, suffered from “confirmation bias”. He noted that the incidents on the ground were “interpreted in a way that assumed a guilty explanation when in reality they were at least also consistent with normal football actions”.
The case of the FA has also weakened when the analysis of telephone data, once a key element of their argument, was rejected after their own experts agreed with the opposite point of view advanced by the independent Paqueta analyst. “FA accepts that these evidence … no longer have the value or weight of the evidence that the FA considered to be the origin,” registered the Commission.
In the end, the panel concluded that the FA had not respected the standard of evidence necessary to support the charges: “The burden remains on the FA throughout the proof of the balance of probabilities … We conclude unanimously that the FA cannot reject the burden on it.”
