Luigi Mangione’s lawyers urged a judge on Saturday to prevent federal prosecutors from asking for the death penalty in the murder of the CEO of Unitedhealthcare, Brian Thompson, arguing that the authorities prejudiced in his case by transforming his arrest into a “Marvel film” and by publicly declaring their desire to see him executed.

“There is a high bar to reject an indictment due to preliminary advertising,” the mangione lawyers wrote in their 114 -page file. “However, there has never been a remote situation like this where the prejudices were so large against a defendant eligible for death.”
Federal prosecutors have October 31 to answer. Mangione must return to court in the federal case on December 5, a few days after the start of preliminary hearings in his state affair. No trial date has been set for both cases.
Mangione, 27, pleaded not guilty to accusations of state and state murder.

The surveillance video showed a masked shooter firing on Thompson, 50, from behind December 4, 2024, when he arrived at a Manhattan hotel for the annual investor conference of his business. In the federal case, Mangione is accused of murder thanks to the use of a firearm, which carries the possibility of the death penalty, as well as offenses in hunting and firearms.
On Tuesday, the judge of his state case rejected the accusations of terrorism which brought the possibility of a prison sentence with compulsory perpetuity without parole. But judge Gregory Carro rejected the request of the defense to fully reject state prosecution, claiming that the dual incrimination argument is premature because none of the cases have been judged or led to guilt.
The state affair will make other accusations, including an intentional murder leader who includes a potential 15 -year punishment in life imprisonment, with the possibility of parole. Unlike the federal system, New York does not have the death.
