The Belgian Institute for Postal Services and Telecommunications (BIPT / IBPT) is looking for comments from service providers, which includes playing companies, on the proposed electronic evidence updates.

The BIPT / IBPT serves as a Belgian federal regulator for electronic communications, postal transactions and audiovisual media services in the Bilingual region of Brussels.

The media surveillance organization has been in conversation with the broader legal world for several years, trying to tighten legislation around European member states which have transnational relations and services.

BIPT / IBPT is looking for comments from several services for new legislation

On July 12, 2023, the EU adopted the final regulations and the directive. However, the BIP has now launched a consultation process and has created an approach draft electronic evidence and regulations.

It is intended to enter into force on August 18, 2026, but all the EU member states must have laid the foundations for this to be inspected by the BIPT / IBPT and the European Parliament by February 2026.

The directive (2023/1544) and the regulations (2023/1543) have stated by the European Parliament refer to play entities as “service providers”. This is made up in a paragraph of the regulation according to which these providers must be able to provide electronic evidence in the context of the legal update that the BIPT / IBPT seeks to apply.

“The categories of service providers covered by this regulation must include, for example, online markets offering consumers and businesses the possibility of communicating with each other, and other accommodation services, including where the service is provided by Cloud Computing, as well as online game platforms and online gaming platforms”, BIPT / IBPT cites the story of the regulation.

Paris companies have asked to comply with the regulation on electronic evidence

Member States receive autonomy to request a point of contact directly in another Member State which operates or has a service provider in operation at this location. This contact is only in the context of criminal procedures.

It allows the Member State or its legal representative to ask the service provider to provide “electronic evidence or” freeze “it (in order to provide it later), in order to investigate and pursue the authors of criminal offenses,” said BIPT / IBPT.

Service providers, such as game operators, are invited to create a point of contact to respond and process requests. The BIPT / IBPT declaration indicates that it would like to “force” the service providers to do so.

However, it would be planned that providers will have to keep discussions with the regulator to achieve a result which meets requests in accordance with the national law of each Member State (the Code of Criminal Procedure in the case of Belgium).

The Belgian watchdog also asks this designated contact to take into account the existing EEE-Cidency regulations. This includes:

  • Directive 2014/41 / EU of the European Parliament and the Council of April 3, 2014 concerning the European Inquiry Order in Criminal matters;
  • Convention established by the Council in accordance with article 34 of the Treaty on the European Union, on mutual aid in criminal matters between the member states of the European Union.
  • The main objectives of the texts to which the public consultation relates (a bill and a draft royal decree) consists in transposing the directive of electronic evidence and implementing the EEE-Cidency regulations.

There could possibly be a serious discussion on the roles that will have to be created to meet the BIPT / IBPT demand with so many game operators offering several Member States of the European Union.
