Weinstein’s conviction could occur next month, but only if there is no new trial on an unresolved rape charge

Harvey Weinstein faces the conviction and a possible new trial in his case of New York sexual crimes, but when they perform – and if he is back in front of another jury – is still in the air.

Manhattan judge Curtis Farber said on Wednesday that he could condemn Weinstein on September 30 – but only if there was no new trial on a rape accusation for the last jury to have not reached a verdict.

Weinstein, 73, was sentenced in June for forcing oral sex on television and the film production assistant and producer Miriam Haley in 2006. The accusation is a penalty of 25 years in prison.

At the same time, the jury acquitted him to force oral sex on another woman, a unique model Kaja Sokola, but could not decide on an accusation that he violated the hairdresser and actor Jessica Mann in 2013.

Manhattan prosecutors told Farber that they were ready to take Weinstein in judgment for the third time on the accusation of rape, which is liable to a sentence of up to four years in prison. It is less time that Weinstein has already served. Mann is on board to testify again, they said.

The prosecutors asked for a date of trial in January, citing the availability of witnesses and their own box. Farber fell to this, saying that a date in January is too far away and conflicts with another unrelated trial that he has already planned. He proposed to have the trial in the fall.

“The case is to be tried this year,” said Farber.

Weinstein Arthur Aidala’s lawyer accepted, telling Farber that he would prefer a trial to “as soon as the court can welcome us”.

The District District Prosecutor Nicole Blumberg said she would ask Mann and other witnesses on their availability for a trial in the fall.

If an autumn trial occurs, this would probably give a #MeToo affair from Weinstein to court to the court while the Manhattan district prosecutor Alvin Bragg is in the last pangs of his candidacy for re -election.

Bragg, a first mandate democrat who has done sexual crimes, a priority, expressed his satisfaction with the condemnation of Weinstein for a criminal sex accusation in Haley’s assault and was resolved in the desire for the boss of the Oscar -winning studio postponed the MANN rape accusation.

“The jury could not arrive at a conclusion as for Ms. Mann, and she deserves it,” said Bragg in June. “This work, above all, concerns survivors and that is why we are ready to move forward.”

Aidala told journalists outside the court that, in his opinion, it is up to the prosecutors to resolve the accusation of rape – either by dropping it and by opening the way to conviction, or by taking it quickly.

Previous procedures

During the first Weinstein trial in 2020, the jurors condemned him for rape Mann and forcing oral sex to the production assistant and producer Miriam Haley.

Then, a court of appeal canceled these convictions and referred the case for new trial due to legal issues involving a testimony of other women.

This spring, a new jury again condemned him to have sexually assaulted Haley and acquitted him to have done the same to another woman who was not part of the first trial. But in the midst of fractive deliberations, the mainly female jury found himself stuck on the accusation linked to Mann.

Mann testified that she also had a consensual and reversed relationship with the Weinstein then married, but that she said to her “I do not want to do this” when he wedged it in the hotel room. She said he had persevered with advances and requests until she “abandons”.

Weinstein is already found guilty of sexual crimes in California. He denies all the allegations against him.
