Meta receives a 48 -hour warning on illegal game advertisements in Brazil

Meta received a legal opinion from the Office of the Attorney General in Brazil on the proliferation of advertisements on its social platforms.

Facebook, Instagram and WhatsApp was responsible for deleting the content, following a search for the Meta advertising library, which contained “hundreds” of active advertisements of profiles without promotion of the game.

In Brazil, the Prix and Paris Secretariat of the Ministry of Finance is the organization responsible for the granting of the authority.

The opinion sent to Meta from the AGU requires the deletion of all the not approved game content within 48 hours, with another warning to approve the Paris platforms without license in the future.

As detailed by the AGU, the communication sent to the social media giant said:

“It is therefore a clearly illegal activity (since these profiles are not authorized by the Ministry of Finance), which can also be linked to tax evasion, money laundering, crimes against relationships with consumers, fraud and other illegal practices, constituting their advertising as an equally illegal activity.”

Legal efforts to eradicate game advertisements in Brazil

Legal education is also aligned with the recent decision of the Supreme Federal Court (STF) on June 26, which declared article 19 of the Civil Rights of Brazil for internet partly unconstitutional.

The article has digital platforms responsible for illegal announcements, unless they can demonstrate diligent and timely efforts to delete such content.

The AGU of Brazil then criticized the recent updates of Meta’s advertising policy, which require authorization to promote online game, noting that the faults of these policies must be addressed.

In May, the Senate approved measures prohibiting Paris advertisements during live sports programs, as well as the ban on printed advertisements and restricting celebrities’ mentions.

Online and television advertisements are limited at 7:30 p.m. – midnight, while radio advertisements are only allowed from 9 a.m. to 11 a.m. and 5 p.m. to 7:30 p.m.

These measures could still be modified or affected by legislators, while many people within the regulated game industry reacted with Fury, warning that the proposals would lead to a new drift to the underground market and confusion as to the legal sites and which are illicit.
