The problem has been resolved to ongoing communication failures within the company and to technical fixes which did not work as promised. The Draftings spoke for the first time to the problem of the problem on May 31, 2023, admitting that this has happened since its launch in March. Two other incidents were later reported on July 14, 2023, and again on February 13, 2024.
In July 2023, Paul Liberman, president and co-founder of Draftkings, signed an underlying declaration claiming that the company “prohibits any use of credit cards to place sports betting on its sports betting platform in the Massachusetts, including without limitation of the funds deposited in a portfolio of players using a credit card while it was located outside the Massachusetts.” However, the problem has not disappeared and the bets funded by the credit card continued to pass.

The Draftings said that the problem had started with “an internal communication” and said that an email from the executive director of MGC, Karen Wells, had been misunderstood. But the commission did not buy this. What really raised the eyebrows was the fact that Draftkings already had a system in place to block the use of credit cards in Tennessee but did not apply it in the Massachusetts. “This structure seems to have permeated these events of non-compliance,” noted the commission.
Besides the fine, Draftkings now has a list of tasks to accomplish. They must show proof that the $ 83,667.92 were returned to 218 clients affected. They must also create a corrective action plan to improve internal communication and prevent this type of violation from reproducing.
And in addition to that, they are required to hire an independent third -party listener to examine any activity funded by the credit card between February 23, 2023, when Draftkings obtained its temporary license and March 10, 2023, when betting officially launched in the state.
The Commission acknowledged that the Draftocks had “declared itself to the Commission” each time it discovered a problem, but stressed that these reports came “after representations repeated by traffic that the fixes they had implemented would have failed”.
The decision was reported by the five commissioners: Jordan Maynard, Bradford R. Hill, Eileen M. O’Brien, Nakisha L. Skinner and Paul Brodeur. In its conclusion, the Commission said: “The information (must) be quickly and widely shared internally within the organization of the operator”. He added: “The commission is still seriously disturbed by the level of poor internal communication to the draft merchants.”
The fine would be the greatest action in charge since sports betting became legal in the Massachusetts in 2023.
