The authority of the Netherlands Gaming Authority raises concerns concerning the results of the risk analysis report


Kansspelautoriteit (KSA) has raised concerns concerning the risk analysis process for online game in the Netherlands, following a study it sanctioned.
The Netherlands Authority for the Game noted in its report that the current systems deployed by game operators do not work “properly” and essentially, not meeting expectations to provide “effective” protections to players.
The “study report on risk analyzes of games offered by approved online game game operators”, published on Friday September 5, showed important concerns that have been raised by KSA on the functionality of the risk analysis frame used in the approved sector.
The measures are an integral part of the obligations on the rights of care established under Dutch law, which all operators must respect. In particular, “high -risk games” are supposed to be attenuated with protective actions such as warnings or deposit limits.
With the research carried out in 2024 in the current year, the 28 operators approved in the Netherlands saw their methods evaluated and evaluated, which led to the conclusion that the systems do not work “optimally”, producing inadequate results despite significant costs and resources.
Move forward to combat risk analysis in the Netherlands
Kansspelautorite has declared that the measures come before the liberalization of the 2021 market and have not been updated since, showing that they are not adapted to the purposes of the contemporary market.
Several concerns have been highlighted by KSA, including obsolete and incoherent methodologies, a level of category VS games, an individual game, insufficient expertise and independence, and high costs with a minimum of advantages.
Under these sections, the respective problems and conclusions have been detailed, the Dutch organization also considering larger regulatory and market implications.
In response to the report and its content, Kanspelautorite has undertaken to link the Dutch Ministry of Justice and Security directly to the proposed reforms to establish a “clearer and more coherent system” for risk analyzes.
This could include compulsory requirements for operators, such as game assessments, standardized methodologies and clearer expertise requirements.
Although the current approach meets minimum legal requirements, the reality is very different, do not be far from the effective protections of players.
KSA is known to maintain strict requirements and expectations, with many recent examples of application against entities that have not been compliant.
One of them was the fine of € 450,000 ($ 524,160) inflicted on the OPTDECK service, the Dutch operator of the Unibet prominent brand, for having offered bets on the prohibited football markets.
