Why is Trump trying to deploy the National Guard in American cities?

The deployment by President Donald Trump of the National Guard in several American cities has approached a series of legal challenges of national and local authorities.

Trump maintains that the use of federal troops is necessary to suppress violence in cities controlled by democrat, repress crime and support his expulsion initiatives.

But several Democratic governors have rejected, saying that deployments are useless and are likely to degenerate tensions.

The Illinois made a legal action on Monday asking a judge to block the deployment of troops in Chicago, while a federal judge temporarily blocked the deployment of members of the National Guard of Texas and California in Portland, Oregon.

While legal battles continue, here is what you need to know about the National Guard:

What is the National Guard and who supervises him?

The National Guard consists of troops mainly based on the State which generally react to questions such as natural disasters or important demonstrations.

The 50 American states, the District of Columbia and the territories of Guam, Puerto Rico and the US Virgin Islands have their own contingent of the national guard troops. These troops can also be deployed abroad and certain units specialize in the fight against forest fires or securing the American border.

Although the National Guard is ultimately a matter of the Ministry of Defense and the President can federate the troops in certain circumstances, requests for support generally start at local level.

The governor of a state launches the appeal to activate the national guard troops in an emergency and may request additional assistance from the president or other states.

The national guard troops, however, have a limited power. They do not apply the law or do arrests, convulsions or research. And a law called posse comitatus law limits the power of the federal government to use military force for internal issues.

How does Trump try to use the National Guard in cities?

Trump has tried to circumvent the normal national guard deployment process several times now.

In June, he took control of the California National Guard to respond to demonstrations against immigration raids in Los Angeles, even if the Californian governor Gavin Newsom opposed. California has brought two prosecutions against the Trump administration.

A trial challenged Trump’s seizure of the National Guard, but a court of appeal finally ruled in favor of the president. In a second trial, a federal judge noted that the use by Trump of the national guard troops in Los Angeles had violated the Comitatus law.

This summer, hundreds of troops from the National Guard arrived in Washington, DC because of what he called a “complete and total situation of anarchy”. Trump quoted homelessness and crime rates as justification.

Trump has now authorized the deployment of 300 national guard in Chicago following immigration demonstrations, in particular external detention facilities. Governor JB Pritzker, a Democrat, allegedly alleged that Trump is trying to “make a crisis” and has pursued a prosecution.

This week, Trump tried to deploy the National Guard in Portland, Oregon, before a federal judge temporarily blocks the action late Sunday evening.

What legal basis does it use to deploy the National Guard?

An little-known provision of American military law governs the president’s power to deploy the National Guard to itself. But so far, the presidents have rarely used it.

10 American code § 12406 allows the president to call the troops of the national guard of any state in service if the United States is “invaded or in danger of invasion by a foreign nation” or “there is a rebellion or a danger of rebellion” against the American government.

Trump invoked this law to federate 2,000 troops of the National Guard in June to support ice missions.

The Secretary of Defense, Pete Hegseth, also cited the law in a memo deployment of 200 members of the Oregon National Guard in federal service on September 28.

“We are very confident in the president’s legal authority to do so,” said the White House press secretary Karoline Leavitt, journalists on October 6. “And we are very confident that we will win on the bottom of the law.”

Why does Trump want to use the National Guard in Portland?

Trump again seeks to use the National Guard to respond to demonstrations, after demonstrations near an ice building in Portland this weekend.

The federal officers, in particular with the Department of Internal Security and Customs and the Border Patrol, clashed with demonstrators who opposed the Mass Deportation Initiative of Trump.

The Portland police office said that they had arrested two people on October 4, who engaged in “in aggressive behavior with each other on the street” and refused to follow the orders. A person was in possession of a bear spray and a foldable baton.

Oregon Public Broadcasting said that federal police had drawn tear gas and smoking cartridges to break the demonstration and arrests several arrests.

Trump said that the city is “burning”, but Oregon governor Tina Kotek said “that there is no insurrection in Portland, no threat to national security”.

The Trump administration decided to send 200 Troops from the California National Guard to the neighboring Oregon to meet the demonstrations.

But the American district judge Karin Immergut, whom Trump appointed during his first mandate, temporarily blocked his action in a pair of consecutive decisions.

On Saturday, judge Immergut prevented Trump from federalizing the Oregon National Guard. “This is a nation of constitutional law, no martial law,” she wrote in her decision.

The next day, she made a temporary ban prescription against him in deployment of the California National Guard in Portland.

The Trump administration is expected to call on.
